Tam Irvine

Senior Solicitor 

Tam is a Senior Solicitor at Smith and Partners, advising commercial clients across a wide range of industries. Admitted in 2014, Tam has practised in both New Zealand and the UK, he is known for his pragmatic, solution-focused approach and ability to get deals across the line.


Tam’s expertise includes regulatory compliance, company formations, mergers and acquisitions, franchise and shareholder agreements, and commercial contract negotiation. He builds strong relationships with clients, taking the time to understand their business goals and translating legal concepts into plain English.


Outside of work, Tam enjoys running up Mt Eden, patting other people’s dogs, and following the Hurricanes and Arsenal — often with frustration but always with loyalty.


Recent Work


Advising individuals and businesses on commercial property transactions, including contract negotiation, risk allocation, and settlement.


Acting for homeowners and purchasers in construction defect and building disputes, including Building Code compliance, warranty issues, and identifying liable parties. 


Representing commercial tenants in lease disputes, including: rent abatement claims, covenant breaches, and enforcing / defending leaseholder rights. 


Advising commercial parties on governance and stakeholder disputes. This experience includes: fact-finding, identifying dispute resolution options and coordinating with senior counsel and technical experts. 


Leading on commercial lending and finance transactions, including loans, guarantees and mortgages.
